By using the SellwisePOS website, submitting a demo request, requesting to create a store, or using the SellwisePOS app, you acknowledge that you have read this policy.

2. What information we collect

The information collected depends on your use of SellwisePOS.

2.1 Demonstration request

When you complete the demo request form, we may collect:

• the name of your business;

• your country;
• your email address;
• your telephone number;
• the information contained in your message.

This information is primarily used to communicate with you, understand your needs and organize a demonstration of the service.

2.2 Request to create a store

When an owner or representative requests to open a SellwisePOS store, we may collect:

• the name and identity of the owner or representative;
• the company name or the name of the business;
• the address of the business;
• the country of operation;
• telephone number;
• email address;
• the type of business;
• the visual preferences or colors chosen for the store;
• the information necessary for activation and configuration of the account.

2.3 Data related to store operation

Once the store is activated, SellwisePOS can process the information necessary for the software to function, including:

• user accounts;
• roles and permissions;
• email addresses associated with accounts;
• product and inventory information;
• sales;
• items sold;
• the configured prices and taxes;
• cash register sessions;
• the information necessary for reporting and the operation of the fund;
• the data necessary for technical support and security of the service.

2.4 Payment data

SellwisePOS does not store full credit card numbers in its own database.

Where card payments are integrated using a payment provider, payment information is processed by the relevant provider under its own terms and privacy policies.

Depending on the country, payment services may in particular be provided by stripe or Mercado Pago.

In the Dominican Republic, when the merchant uses their own payment terminal, SellwisePOS does not directly process the card data. The merchant can record the sale in SellwisePOS as an external card payment.

2.5 Technical data

When you use our site or application, certain technical information may be processed to enable the operation of the service, security and troubleshooting.

Depending on the configuration of the service, this may include:

• the type of device;
• the browser used;
• certain technical connection information;
• the information necessary to maintain the session;
• technical logs necessary for operation and safety.

SellwisePOS does not use this information to sell personal profiles to third parties.

3. Cookies and similar technologies

SellwisePOS may use cookies and similar technologies necessary for the operation of the site and application.

Language witness

A witness called preferred_lang can be used to remember the user's preferred language for up to a year.

Session light

A session cookie may be used to enable authentication and maintain an active user session.

5. Merchant Customer Data

SellwisePOS provides a cash register tool for businesses.

The merchant remains responsible for the information it collects directly from its own customers and the manner in which it uses it.

When information concerning a business's customers is entered into SellwisePOS, the merchant must ensure that this collection, use and communication complies with the laws applicable to it.

The merchant also remains responsible for the information it provides to its customers regarding the processing of their personal information.

SellwisePOS acts as a technology provider to the trade for the functionalities offered by its software and does not establish the commercial purposes specific to each merchant.

6. Service Providers

SellwisePOS may use technology service providers to provide certain functions of the Service.

Supabase

The database and certain technical services of SellwisePOS use Supabase. Depending on the infrastructure used, some data may be hosted or processed in the United States.

Resend

Transactional or service-related emails may be sent using Resend.

stripe

In countries where Stripe Connect is used, Stripe processes payments in accordance with its own terms and privacy policies.

Mercado Pago

In Chile, when Mercado Pago is used, payment processing is carried out by Mercado Pago under its own terms and policies.

These providers may process certain data only to the extent necessary to provide their services.

7. Transfers and processing outside Quebec or Canada

Some technology providers used by SellwisePOS may be located outside of Quebec or Canada.

For example, some SellwisePOS data may be hosted or processed in the United States by its technology providers.

When personal information is communicated or transferred outside of Quebec or Canada, SellwisePOS takes the measures required by applicable laws in order to regulate these transfers when necessary.

8. Security

SellwisePOS takes reasonable measures designed to protect personal information from loss, theft, unauthorized access, unauthorized use, disclosure or modification.

Security measures may include access controls, authentication mechanisms and technical measures related to the infrastructure used to provide the service.

However, no computer system or service transmitted over the Internet can be guaranteed to be completely free from security risks.

9. User Access and Merchant Responsibilities

Users must protect their usernames, passwords and, where used, checkout PINs.

The merchant is responsible for:

• maintain the confidentiality of its access;
• control the people authorized to access its store;
• assign appropriate roles and permissions;
• remove access that is no longer necessary;
• promptly report any unauthorized use of which it becomes aware.

Activities carried out using an account or access assigned to a user may be associated with the respective store.

10. Retention of Information

SellwisePOS retains personal information for the period reasonably necessary for the purposes for which it was collected, for the provision of the service, for the management of the commercial relationship and for compliance with applicable legal obligations.

A demo or store creation request may be retained while the request is being processed and for the period reasonably necessary for the resulting relationship.

Data associated with an active store may be retained for the duration of the service.

After the end of the service, certain data may be retained when necessary to comply with a legal, accounting, tax or contractual obligation or to establish, exercise or defend rights.

When the information is no longer necessary, it may be deleted or anonymized in accordance with applicable practices.

Subject to the limits provided by applicable laws, you may request:

• the rectification of inaccurate or incomplete information;
• information about the use or disclosure of certain information;
